Terms of Use and License
Launch requirement: This is a practical business draft, not legal advice. Have a Florida attorney review it before accepting sales.
1. Ownership
All photographs, previews, text and visual materials on this website are owned by Scott Simpson Photography or used with permission. Purchasing a file does not transfer copyright.
2. Personal Screen license
A Personal Screen license permits one purchaser to display the supplied 3,840-pixel file on personally owned computers, phones, tablets and private digital displays. Printing, public distribution, resale, sublicensing, commercial use and removal of embedded ownership information are prohibited.
3. Personal print licenses
Standard and Full-Resolution Personal Print licenses permit one purchaser to make up to three physical prints for display within one household using the supplied file. The Full-Resolution tier supplies the largest available personal print master. The file may be delivered to a printing provider solely to produce those prints. The purchaser must not sell prints, transfer the file, publish the clean file online, create merchandise or use the image commercially.
4. Commercial use
Advertising, business websites, editorial publication, packaging, products, merchandise, broadcast, client work and other revenue-connected uses require a separate written commercial license.
5. Digital delivery and refunds
Because digital files cannot practically be returned, completed downloads are generally nonrefundable except where required by law or when the delivered file is materially defective. Contact the business promptly if delivery fails.
6. Printing
The purchaser chooses and contracts directly with the printing provider. Scott Simpson Photography does not control lab output, cropping, paper, color calibration, shipping or finished-product quality and is not responsible for third-party printing results.
7. Prohibited conduct
Visitors must not scrape the site, bypass access controls, remove watermarks, train models on the images, falsely claim authorship or attempt to obtain protected files without payment and authorization.
8. Liability
To the fullest extent permitted by law, the website and files are provided without implied warranties. Liability arising from a transaction will not exceed the amount paid for the affected license.
9. Governing law
These terms are governed by Florida law, without regard to conflict-of-law principles. Venue will lie in a court of competent jurisdiction serving St. Johns County, Florida.
